This branch provides technical information and assistance on Tennessee Occupational Safety and Health standards to employees, employers and the general public. It develops occupational safety and health standards or adopts the federal standards. It develops rules, regulations and administrative directives governing the enforcement of the Tennessee Occupational Safety and Health Act of 1972, as amended, and the standards promulgated thereto. It provides interpretations of standards and regulations informally by phone or formally by letter or by publishing a directive. The branch processes applications for variances from the standards and provides other information, both technical and general, about Tennessee's plan for occupational safety and health. The branch also processes all requests for inspection information pursuant to the freedom of Information Act or the Tennessee Open Records Act T.C.A. § 10-7-503.
The Standards and Procedures Branch also provides copies of the occupational safety and health "It’s The Law" poster which is required to be posted in each establishment and at every work site.
The Tennessee Occupational Safety and Health Act of 1972, as amended can be found in the Tennessee Code Annotated TCA §§50-3-101 through 50-3-919.
Rules of the Department of Labor and Workforce Development dealing with Occupational Safety and Health are contained in the Department of Labor and Workforce Development Rules 0800-01-01 through 0800-01-11.
The Commissioner, Tennessee Department of Labor and Workforce Development, has adopted Federal Occupational Safety and Health Standards contained in Title 29 Code of Federal Regulations (CFR) Parts 1910, 1926 and 1928 pursuant to T.C.A. §50-3-201. 29 CFR 1910 is the OSHA Standards for General Industry, 29 CFR 1926 is the OSHA Standards for the Construction Industry, 29 CFR 1928 is the OSHA Standards for Agriculture.
The Construction Industry 29 CFR Part 1926 and Agricultural Standards in 29 CFR Part 1928 were adopted verbatim. The Occupational Safety and Health Standards for General Industry 29 CFR 1910 was adopted with some differences which can be found in Rule 0800-01-01. This rule also contains the Tennessee OSHA Air Contaminant Standard and Table Z-1-A. An online version of Table Z-1-A has been created with a table of contents for easy use.
Tennessee OSHA also enforces the Tennessee Hazardous Chemical Right-To-Know Law which contains requirements in addition to those set forth in the Hazard Communication Standards, 29 CFR 1910.1200 and 29 CFR 1926.59. This provision is contained in Rule 0800-01-09.
