Aquatic Resource Alteration Permit (ARAP) Notices

TO WHOM IT MAY CONCERN: Below are current public notices of permit applications, notice of individual permit decisions, announcement of public hearings or meetings, and/or rule-making activities. Public comment and participation are encouraged on all of these issues.

The applications described below have been submitted for Aquatic Resource Alteration Permits under The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108. In addition, a federal permit may be required from the U. S. Army Corps of Engineers or from the Tennessee Valley Authority under §404 of the Clean Water Act and §26a of the Tennessee Valley Authority Act , respectively. Section 401 of the Clean Water Act requires that an applicant must obtain a water quality certification from the state when a federal permit is required. These notices may cover applications subject to §401 or navigation permitting (Rule 1200-04-08).

No decision has been made whether to issue or deny these permits. The purpose of these notices is to inform interested parties of this permit application and to ask for comments and information necessary to determine possible impact to water quality. Persons wishing to comment on a proposal are invited to submit written comments to the department. Written comments must be received within thirty days of the date that the notice is posted. Comments will become part of the record and will be considered in the final decision. The applicant’s name and permit number should be referenced.
The permit application, supporting documentation including detailed plans and maps, and related comments are available for review and/or copying at the department’s Natural Resources Section.

Interested persons may also request in writing that the department hold a public hearing on an application. The request must be filed within the comment period, indicate the interest of the person requesting it, the reasons that the hearing is warranted, and the water quality issues being raised. When there is sufficient public interest in water quality issues, the department shall hold a public hearing in accordance with Rule 1200-4-7-.04(4)(f).

In deciding whether to issue or deny a permit, the department will consider all comments of record and the requirements of applicable federal and state laws. In making this decision, a determination will be made regarding the potential lost value of the resource compared to the value of any proposed mitigation. The department shall consider practicable alternatives to the alteration. The department shall also consider loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource, and adverse impact to unique, high quality, or impaired waters.

PH2009_18 The division will hold a public hearing regarding an application for §401 Water Quality Certification associated with marina expansion at Cove Ridge Marina on Watuaga Lake in Carter County. NRS09.187 City of Clarksville Gas and Water Department proposes to install 14,305 linear feet of gravity sewer line for the Hemlock Semi-Conductor Industrial site and future forecasted growth that will require five crossings of Spring Creek and four tributaries; Clarksville, Montgomery County.

NRS09.189 City of Memphis proposes to construct the Grays Creek interceptor sewer extension 2A in Memphis, Shelby County. The extension will be approximately 4,500 linear feet and will replace the existing force main. NRS09.217 Scott County Schools proposes to expand the existing Burchfield Elementary School that will require the placement of fill in 0.38 acres of wetland; Oneida, Scott County.

NRS07.357 Tollgate Farms, LLC proposes to water withdrawal for commercial landscaping irrigation 30 gallons per minute (0.067 cfs) for 24 hours per day. West Harpeth River; Williamson County

NRS09.176 TDOT proposes to widen approximately 4.7 miles of SR-33 along an existing alignment. New construction will consist of three (3) 12 ft. lanes, 10 ft. paved shoulders, varied guardrail, and either curb and gutter or 20 ft. typical to ditch centerline. PH009-010 The division will hold a public hearing to seek comments concerning an application for a state water quality permit.  The hearing is in regards to the proposal by Ron Barker/ RPB Builders (NRS08.058) to construct a commercial development at the corner of Highway 60 and Paul Huff Parkway that will require the placement of fill in 4.88 acres of jurisdictional wetland. The public hearing will be held Thursday, August 13, 2009, 6:30 pm at the City Of Cleveland Council Chambers, 190 Church Street NE, Cleveland, Tennessee 37311.

Approximately 106 cubic yards of material will be placed riverward of normal pool elevation behind sheet pile wall, construct a 30 ft. X 120 ft. pile supported dock, and construct 1,600 linear feet of road and sidewalk running parallel to Langford Avenue and connecting to the Northern end of Lincoln Street, and construct a 20-car capacity surface parking area adjacent to the proposed kayak landing.

NRS 09.048 TDOT proposes to reconstruct 2.361 miles of SR-20 from the Henderson County Line to Bear Creek Road near Parsons along existing alignment. Mitigation for stream impacts not mitigated on site (1228’) would be mitigated by payment of $245,600.00 to the Tennessee Stream Mitigation Program. Wetland impacts (0.858 ac) would be mitigated by debiting, at a 4:1 ratio, 3.43 acres of available credit from the Obion Wetland Mitigation Bank. Decatur County.

NRS 09.050 TDOT proposes to construct approximately 0.383 miles of SR-2 (US-11) along an existing alignment. The existing centerline of SR-2 will be shifted approximately 40-50 ft. north, removing the existing S-curve. The new construction will consist of one (1) new 520 ft. 4-span concrete girder bridge over Lookout Creek (STR-1), outfall structure and utility line crossing in an unnamed tributary to Lookout Creek (STR-2), four (4) 12-ft. lanes, 10-ft. shoulders, 21 ft. typical to ditch centerline and varied guardrail. This will also include the relocation of approximately 200 ft. of a second unnamed tributary to Lookout Creek (STR-3), which will be replaced on-site and in-kind. NRS09.051 TDOT proposes to construct approximately 0.123 miles of SR-131 along an existing alignment. The new construction will consist of two (2) 12-ft. lanes, 8ft. shoulders (6 ft. paved, 2-ft. sod), and varied guardrail. Construction will consist of replacing the existing 1-lane bridge over Meadow Creek with 51.5ft. of 3@16ft. X 6ft. slab bridge and associated rip-rap, associated outfalls, approximately 0.120 acres of wetland fill, and partial relocation of Meadow Creek and two (2) tributaries to Meadow Creek to avoid fill from a wider roadway.
