Rule Implementation Information


Rule Chapter 1200-01-20 Asbestos Accreditation Requirements became effective on June 23, 2009. 


These Rules are applicable to all persons and firms who perform asbestos activities in schools or public and commercial builidings. 


Training Providers, Persons, LEA Employees, Firms and/or Firm-LEAs shall apply for accreditation in Tennessee within ninety (90) days (before or on September 23, 2009) pursuant to Rules: 1200-01-20-.02 – Accreditation of Training Provider and Training Course(s); 1200-01-20-.03 – Accreditation of Persons and Firms Engaged in Asbestos Activities; and 1200-01-20-.08 – Implementation of Rule Chapter 1200-01-20 Asbestos Accreditation Requirements.


The Asbestos Accreditation Requirements Rules implements Tennessee Code Annotated (T.C.A.) Section 62-41-101 et.seq., Tennessee Asbestos Contractor Accreditation and Regulation Act of 1993. The Tennessee Department of Environment and Conservation, Division of Solid and Hazardous Waste Management, Toxic Substances Program will administer the asbestos accreditation program in Tennessee.


The Asbestos Accreditation Requirements are applicable to all persons and firms who perform asbestos activities in schools or public and commercial buildings. 


These Rules stipulate that only accredited persons shall perform asbestos activities inclusive of developing management plans in schools, project designs, conducting response actions, inspections, and collecting clearance air samples to confirm the completion of a response action involving friable and non-friable asbestos-containing materials and asbestos-containing building materials in schools or public and commercial buildings.


Under the Asbestos Accreditation Requirements Rules, Training Providers must be accredited by Tennessee to offer asbestos training course(s) in Tennessee, following the procedures outlined in the Rule 1200-01-20-.02 – Accreditation of Training Provider and Training Course(s).


Local Education Agencies (LEAs), public and private (non-profit) shall comply with the requirements of the Rules.  LEA’s and its employees are exempt from the financial obligation of fees for accreditation and re-accreditation outlined in Rule 1200-01-20-.05 - Fees, when employees directly employed by LEAs and their school system who conduct the asbestos activity(ies) to ensure compliance with AHERA requirements detailed in the Code of Federal Regulations, Title 40, Part 763, Subpart E and these Rules.  The LEA shall apply for a Firm-LEA accreditation and for it’s employee(s) accreditation in their respective discipline(s) in order to utilize the employee fee waiver provision.   


Accreditations granted under this provision are only applicable for asbestos activities conducted at that specific LEA and their school system.
