Assistant Attorney General – Healthcare Division, Civil Medicaid Fraud

The Tennessee Attorney General and Reporter represents all State executives, officials, departments, boards, agencies, and commissions in matters arising from their public duties. Such representation includes participation in litigation, transactional matters, and giving day-to-day legal advice to a wide variety of State entities. The Attorney General's Office employs approximately 200 attorneys organized into 16 legal divisions within 5 sections.

About the Healthcare Division, Civil Medicaid Fraud:

The Healthcare Division is part of the State Services and Litigation Section of the Attorney General’s Office. The Division’s Civil Medicaid Fraud (CMF) unit investigates and prosecutes civil cases of Medicaid fraud against health providers and related parties. These efforts serve to deter the submission of False Claims to TennCare, Tennessee’s Medicaid program, and restore ill-gotten gains to the state. Most of CMF’s cases result from qui tam actions brought pursuant to the Tennessee Medicaid False Claims Act, as well as referrals from TennCare’s Office of Program Integrity. CMF works on a regular basis with TennCare, the Tennessee Bureau of Investigation, the Tennessee Department of Health, U.S. Department of Justice, the U.S. Attorney’s Offices, and other agencies.

Job Overview:

The CMF team is seeking an organized and detail-oriented attorney to focus on investigating and litigating cases under the Tennessee Medicaid False Claims Act for the State. This position will require an attorney who is adept at learning and synthesizing relevant governing law and applying them to complicated fact patterns. Attorneys on the CMF team regularly perform the following duties, among other tasks as needed:

  • Develop effective litigation and investigation strategies for assigned cases.
  • Analyze all relevant evidence and formulate persuasive legal theories.
  • Timely and effectively work assigned cases to their appropriate conclusion.
  • Draft subpoenas and information requests to gather evidence.
  • Interview potential witnesses and take testimony by deposition.
  • Review documentary evidence, including medical records.
  • Utilize e-discovery and case management software.
  • Review data analysis evidence related to health care providers’ submission of claims to TennCare for reimbursement for services rendered.
  • Work with physicians, medical billing coders, and other expert consultants and witnesses.
  • Coordinate with other state and federal agencies and enforcers in joint investigations and litigation.
  • Draft pleadings, motions, briefs and other court documents.
  • Argue motions and participate in trials.
  • Negotiate settlements.

The ideal candidate will have the following qualifications:

  • Juris Doctorate and Tennessee bar admission or pending admission.
  • Strong oral and legal writing skills.
  • Two or more years of civil litigation experience.
  • Familiarity with the reimbursement processes for medical services.
  • Negotiation experience.
  • The ability to work as part of a team and to explain legal issues to non-attorneys.
