The Insurance Division is responsible for enforcing the state's insurance laws, rules and regulations. There are more than 1,700 insurance companies, accredited reinsurers, trusted reinsurers, limited capital reinsurers, surplus lines companies and mutual risk retention groups, authorized to do business in Tennessee. There are five sections within the Insurance Division committed to serving the public interest. Actuarial Section - Shawn Kiser Hawk - Director Howard Magill, Life and Health Unit, Manager - 1-800-861-1270 or (615) 741-2825 This unit reviews life, health, and credit life, long-term care, disability and legal insurance policy rates, rules and forms filed by licensed companies, to determine compliance with Tennessee statutes. It also handles annual certifications from utilization review agents and answers questions about all life and health issues. John Duncan, Property and Casualty Unit, Manager - (615) 741-2333 This unit reviews personal and commercial property and casualty policy rates, rules and forms filed by licensed companies to determine compliance with Tennessee statutes. It also reviews vehicle protection products warranty programs for compliance with Tennessee Law and answers questions about all property and casualty insurance matters. Mike Shinnick, Workers Compensation Manager - (615) 741-0472. This unit reviews rates, rules and form filings associated with Workers' Compensation insurance. It also oversees the the administration of Tennessee Workers Compensation Insurance Plan (assigned risk pool) and answers questions about workers' compensation insurance and takes inquiries from persons aggrieved by the application of workers' compensation rating systems. Agent Licensing Section - Brenda Sechler - Director 1-888-416-0868 or (615) 741-2693 This office is responsible for the licensing and regulation of insurance producers, business entities, title agencies, surplus lines agents, automobile club agents, education providers and life settlement providers, brokers and representatives. Approximately 106,000 producers are licensed to do business in Tennessee each year. Consumer Insurance Services - Vickie Trice - Director (615) 741-2218 or 1-800-342-4029 (inside Tennessee) Consumer Insurance Services exists to educate consumers and mediate insurance-related disputes. The educational programs cover a vast array of insurance and insurance related issues, disaster assistance and referrals to special programs.
Financial Affairs Section - Vacant - Director The Financial Affairs Section regulates the financial and operational condition life, property and casualty, title and captive companies; as well as, health maintenance organizations, governmental entity pools, self insurance groups and risk retention groups. This section is divided into three units; Examination, Analytical, and Statistical. Philip Blustein - Chief Examiner (615)741-6796 The Examination Unit performs examination of Life, property and casualty, title and captive companies; as well as, health maintenance organizations, governmental entity pools, self insured groups, and risk retention groups domiciled in Tennessee. The duties and responsibilities of this section encompass examining company records including but not limited to the financial statements, bylaws, charter, contracts, agreements, conflict of interest, investment activities, dividends and distributions, market conduct activities, and producing an examination report that addresses the company's compliance with state laws, rules and regulations. Linda Gay , ASA 4 (615) 741-1692 The Statistical Unit is responsible for maintaining securities that are pledged to the Commissioner of Commerce and Insurance by various companies regulated by the Department. This unit issues Certificates of Deposit, Certificates of Compliance, and Certificates of Authority and maintains the official list of companies licensed or authorized by the Insurance Division.
Fraud Investigation Section - Judith Nash Director - This Section investigates allegations of abuse, fraud, waste, and other violation of State or Federal Law. The Section ensures that allegations of fraud as related to the Department of Commerce and Insurance are investigated in a manner that best serves the Department, Insurers and Policyholders. The Section functions both on a proactive and referral basis.
