Policy Memorandum 250.12-02:  Lobbying Certification Statements

 

This memorandum is a restatement of policy previously issued as Food Distribution Policy Memorandum 91-2 on March 26, 1991.  Any changes made to the original text are in bold.

 

We have received additional guidance from the National Office regarding the implementation of the department regulation concerning restrictions on lobbying (7 CFR 3018 - Lobbying Restrictions).

 

Under the new policy, certification statements and disclosure statements are required only from primary recipients and first-level subrecipients of Federal grants or contracts over $100,000.  For example, State agencies and subgrantees under State agencies, such as School Food Authorities, Child Care Centers, and Summer Program Sponsors are required to submit certifications; however, contractors under these organizations would not be required to submit certifications, as they are not directly contracted with the primary recipient.  Certifications regarding lobbying are to be kept on file with the agency’s contract or agreement and all disclosure statements are to be forwarded to the Regional Office.
